BUTLERS WITH BUMS : TERMS AND CONDITIONS
Important Note: All bookings from butlers with bums services are subject exclusively to the following terms and conditions. You will be deemed to accept these terms and conditions by accepting a Quotation for a butler with us by email, telephone or letter or by paying the Deposit, whichever occurs first. Once you accept our Quotation, you will have a binding legal contract with us incorporating the following terms and conditions.
*Please not theses terms and conditions apply to all different staff the work for Butlers with Bums.
(The job role may be different depending on what you have ordered )
Terms and Conditions
1.1. “Booking Date” means the date you accept our Quotation whether your acceptance is made by email, by telephone or letter or by paying the Deposit (whichever occurs first);
1.2. “Bank Account” means our bank account in the name of Butlers with Bums Limited the details of which are specified on our Quotation
1.3. “Deposit” means the deposit specified in our Quotation and referred to in clause 3.2 below;
1.4. “Event” means the event or function specified in our Quotation;
1.5. “Event Date” means the date specified in our Quotation for the Event;
1.6. “Quotation” means our written quotation in respect of an Event sent by us to you by email.
1.7. “us”, “our” or similar expression means Butlers with Bums Ltd a limited company registered in England with company number 7699821 and with registered address at 44 Drove Creasent, Mile Oak, Portslade, Brighton BN41 2TA
1.8. “you”, “your” or similar expression means the person we have spoken to.
2.1. We will provide the number of Staff specified in our Quotation to provide butler services at the Event subject to these terms and conditions.
2.2. Our Staff provide the following services: meeting and greeting your guests, serving food and drinks, participating in any games you may have planned, posing for photographs with you and your guests and generally hosting you and your guests.
2.3. While we will endeavour to provide you with a butler who matches your preferences, the selection of a butler to provide the butler services remains at our sole discretion. You will not be entitled to any refund or reduction if we are unable to provide a butler matching any preferences specified by you.
2.4. Our Staff are self-employed independent contractors and are not our employees.
2.5. You agree to treat our butlers in a non-discriminatory manner and you will not request, encourage or (in so far as it may be in your control) permit any butler to do or omit to do anything at the Event
2.5.1. which is unlawful or illegal; or
2.5.2. which is unsafe (whether to the butler or any other person); or .
2.5.3. with which the butler is uncomfortable.
2.6. In the event of any breach of the clauses stated above, our butler will be entitled to leave the Event immediately and you will not be entitled to any refund of any charges paid.
3. Adult nature of services
3.1. You acknowledge that you have reviewed the photographs posted on our website at www.buterswithbums.com and are familiar with the nature of the uniform which will be worn by our butler at the Event. All staff are over the age of 18 years of age.
3.2. You confirm that you and your guests at the Event will be 18 years of age or older and that your guests will not be offended or embarrassed by the extent of the nakedness of our butler (s).
3.3 Butlers with Bums limited does not accept any responsibility for any member of the event being 18 years old or under as this is the responsibility of the lead booking name to insure this is fulfilled.
4. Payment terms
4.1. Our charges per butler are £30-£95 per hour plus travel costs.
4.2. A deposit payment of £30.00 will be required for all Butler bookings, other services this deposit amount will vary. The remains balance is due 14 days before the booking, if you booking is in less than 14 you will be required to make the full balance payment.
4.3. Please note that we will not confirm your booking until you have paid your Deposit.
4.4. Payments may be made by bank transfer to our direct bank account, over the phone or we can send you a Paybylink to which you can then make your payment.
5.1. If, after the Booking Date, you wish to change the time, date or location of the Event, you need to give us as much notice as possible but at least 7 days notice or a £10 charge will apply.
5.2. If we are able to accommodate a change to the time, date or location of the Event, such change will be subject to you paying any additional charge relating to the change.
5.3. If, at any time (including during the Event itself), you wish to extend the number of hours for which you require the services of the butler, you need to contact us immediately (and if during the Event, you should contact us on the mobile phone number on our front page of the website). If we able to agree the additional hours, you agree to pay our charges for those additional hours. Payment for the additional hours should be made payable either over the phone or via bank transfer asap.
6.1. If you wish to cancel a booking after the Booking Date, the following cancellation charges apply:
6.1.1. a cancellation of 14 days or less before the Event Date: will result in a loss of full loss of amounts paid, anything prior to 14 days before the booking will result in a £30 loss of deposit amount for admin fees. Other services that have a higher deposit amount will also be lost should you cancel the booking 14 days before.
7. ‘No shows’ and delays
7.1. In the unlikely event that the butler booked for your event fails to arrive at the venue for your event, we will refund your payment made to us in full but we will have no further liability to you for any claims;
7.2. In the event that the butler is delayed in arriving at your event at the time booked, the period for which the butler will provide the butler services will be extended by the length of time for which he was late (and if this is not practical in the circumstances, we will provide a pro rata refund of your payment to us but we shall have no further liability to you for any claims).
If you have any complaints about the services provided by our butlers you should contact us as soon as possible (preferably during the Event on the mobile phone number on our Quotation) but in any event within 48 hours of the Event Date. We may not be able to deal with complaints made after this time.
9. Exclusion and limitation of our liability
9.1. Given the low charges that we offer for the provision of butler services, we need to exclude or limit certain forms of legal liability.
9.2. We do not accept any liability for
9.2.1. any damages for disappointment or inconvenience; or
9.2.2. any special, consequential or indirect damages or loss of any nature,
which you and/or your guests may suffer, directly or indirectly, as a result of any breach of contract, negligence, tort or other default by us or our butlers.
9.3. Where our liability is not excluded under the previous clause, then our liability is limited to the amount of the total charges paid by you to us in relation to the butler services concerned.
9.4. Without limiting the generality of the preceding sub-clauses, we accept no liability for any offence or embarrassment caused to you or any of your guests at the Event by the nature of the uniform that our butler will wear at your Event or any aspects of the butler’s nakedness.
9.5. The above clauses do not exclude or limit our liability for:
9.5.1. any death or personal injury caused by our negligence;
9.5.2. any fraud on our part.
9.6. Nothing in these terms and conditions affect any statutory right that you may have as a consumer.
If you send us any photographs taken at the event you unconditionally and irrevocably agree that we may post those photographs on our or on third party websites or include these photographs in our brochures or other marketing materials. If you have not taken such photographs yourself, you agree that you have the unconditional and irrevocable agreement of the person who took the photographs to such use.
- Governing law
These terms and conditions are governed in all respects by English law.
12. Choosing your butler
When requesting/ choosing a butler we will send you a picture(s) of who we will look to send to you. If we do have to change the butler last minute we accept no responsibly for requests of refunded or compensation being sent a different butler. We will always make you aware that we have had to change your butler you have request but sometimes this falls out of are control.
